Terms of Service
These Terms govern your use of apexdiscover.ai and the Apex services, provided by Apex Discover LLC, a Wyoming limited liability company (“Apex,” “we,” “us”). By using the site, requesting a free AI visibility scan, or signing a service order, you agree to them. Written the way we write everything: plainly. We rewrote this page on August 2, 2026 to describe Apex as what it is: software. That rewrite is pending our counsel's review.
1. The services
Apex is software. It measures how often AI assistants (such as ChatGPT, Gemini, Perplexity and Claude) mention or recommend your business in response to relevant questions, shows you what is holding those results back, and drafts corrections: listings fixes, review requests, structured website data, and answer pages. Apex publishes none of it. You or your agency reviews every draft and decides what goes live, where, and when. The platform is the same on every plan; your service order sets the term, the fees, and the billing period.
2. The free scan
The free AI visibility scan is provided as-is, for your information, with no obligation on either side. To run it, we need accurate business details from you; results reflect the checks we ran at that time and may differ from checks run later. That variability is precisely what our ongoing measurement accounts for.
3. No guarantees of AI outcomes
AI engines decide their own answers, and their behavior changes without notice. Neither we nor any honest provider can guarantee that an AI assistant will recommend your business, or guarantee lead volume, revenue, rankings, or any specific appearance rate. What we commit to is stated in your service order: the measurement cadence, what Apex checks, and the reporting you receive.
4. Your responsibilities
You agree to: (a) provide accurate information about your business and keep it current; (b) review what Apex drafts and decide for yourself what to publish, since Apex publishes nothing on your behalf; (c) hold the rights to any content and materials you provide; and (d) not use our services for a business engaged in unlawful activity. We may decline or discontinue service where information is materially false or where the use you intend would violate a platform's terms.
5. Reviews: done honestly
Apex drafts review requests for you to send. They ask your real customers for honest feedback, and nothing more. We do not create fake reviews, pay for reviews, or suppress negative ones, and we will not build anything that does, at a client's request or otherwise. You agree not to ask us to, and not to use what Apex drafts for anything else.
6. Fees and billing
Paid plans are billed in advance at the rates and for the billing period set out in your service order. Fees are exclusive of taxes. Either party may terminate as described in the service order; amounts already paid for the current billing period are non-refundable unless the order says otherwise.
7. Intellectual property
You own your business information, brand, and anything Apex drafts for you, once paid for. We own the Apex platform, measurement methodology, dashboards, and report formats. We may use aggregated, anonymized measurement data (never identifying you) to improve our benchmarks and services.
8. Confidentiality and data
Each party will protect the other's non-public information. Our handling of personal information is described in our Privacy Policy. Our standard Data Processing Agreement is published and does not have to be requested; if your organisation needs it signed, email legal@apexdiscover.ai.
9. Disclaimers
Except as expressly stated in a service order, the services and site are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose. Third-party platforms (AI engines, listing directories, review sites) are outside our control and may change or discontinue features at any time.
10. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, consequential, or punitive damages, or lost profits. Our total liability arising out of the services is capped at the fees you paid us in the twelve months before the claim.
11. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. The parties will first attempt in good faith to resolve any dispute informally; unresolved disputes will be brought in the state or federal courts located in Wyoming.
12. Changes and contact
