Terms of Service

Effective date: July 14, 2026 · Apex Discover LLC, a Wyoming limited liability company ("Apex Discover," "we," "us")

These Terms govern your use of apexdiscover.ai and the Apex Discover services. By using the site, requesting a free AI visibility scan, or signing a service order, you agree to them. Written the way we write everything — plainly.

1. The services

Apex Discover measures how often AI assistants (such as ChatGPT, Gemini, and Perplexity) mention or recommend your business in response to relevant questions, and — depending on your plan — performs work intended to improve those results, including business-listings management, review collection and response, structured website data, and content. The specific services, term, and fees for paid plans are set out in your service order.

2. The free scan

The free AI visibility scan is provided as-is, for your information, with no obligation on either side. To run it, we need accurate business details from you; results reflect the checks we ran at that time and may differ from checks run later — that variability is precisely what our ongoing measurement accounts for.

3. No guarantees of AI outcomes

AI engines decide their own answers, and their behavior changes without notice. We do not — and no honest provider can — guarantee that any AI assistant will recommend your business, guarantee lead volume, revenue, rankings, or any specific appearance rate. What we commit to is stated in your service order: the measurement cadence, the work we perform, and the reporting you receive.

4. Your responsibilities

You agree to: (a) provide accurate information about your business and keep it current; (b) give us the access needed to perform the services (for example, your Google Business Profile and website); (c) hold the rights to any content and materials you provide; and (d) not use our services for a business engaged in unlawful activity. We may decline or discontinue service where information is materially false or where the work would violate a platform's terms.

5. Reviews — done honestly

Our review engine asks your real customers for honest feedback. We do not create fake reviews, pay for reviews, or suppress negative ones, and we will not do so at a client's request. You agree not to ask us to.

6. Fees and billing

Paid plans are billed monthly in advance at the rates in your service order. Fees are exclusive of taxes. Either party may terminate as described in the service order; amounts already paid for the current billing period are non-refundable unless the order says otherwise.

7. Intellectual property

You own your business information, brand, and any content we create for you once paid for. We own the Apex Discover platform, measurement methodology, dashboards, and report formats. We may use aggregated, anonymized measurement data (never identifying you) to improve our benchmarks and services.

8. Confidentiality and data

Each party will protect the other's non-public information. Our handling of personal information is described in our Privacy Policy. Clients who require a data processing agreement (DPA) can request our standard DPA at legal@apexdiscover.ai.

9. Disclaimers

Except as expressly stated in a service order, the services and site are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. Third-party platforms (AI engines, listing directories, review sites) are outside our control and may change or discontinue features at any time.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, consequential, or punitive damages, or lost profits. Our total liability arising out of the services is capped at the fees you paid us in the twelve months before the claim.

11. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. The parties will first attempt in good faith to resolve any dispute informally; unresolved disputes will be brought in the state or federal courts located in Wyoming.

12. Changes and contact

We may update these Terms from time to time; material changes will be posted here with a new effective date, and continued use after that constitutes acceptance. Questions: legal@apexdiscover.ai.
